The Legal Necessity of Possession in Hiba (Gift) | 2019 MLD 1070

The Legal Necessity of Possession in Hiba (Gift) | 2019 MLD 1070

In Pakistani jurisprudence and Islamic Law, a gift (Hiba) is not merely a verbal promise or a written document; it is a three-step legal process. This post highlights a critical ruling from 2019 MLD 1070, which reinforces that a gift is incomplete and legally void if the physical possession of the property is not handed over to the recipient.
According to the law, for a Hiba to be valid, three essential elements must be met:
1. Declaration: The donor must clearly state the intention to give the gift.
2. Acceptance: The donee (recipient) must accept the gift.
3. Delivery of Possession: The most vital step—the donor must physically transfer control or possession of the property to the donee.
As cited in 2019 MLD 1070, without the delivery of possession, the Hiba remains imperfect and cannot be enforced or recognized by the courts. Whether you are dealing with family settlements or property transfers, ensuring the legal transfer of possession is mandatory to prevent future litigation.
