The precedent set in 2013 CLC 897 addresses the specific scenario where a wife voluntarily deserts her husband’s home without a "justifiable legal cause." According to this ruling:

• Entitlement: Maintenance is a reward for the wife's presence and availability in the marital home.

• The "Nashizah" (Disobedient) Clause: If a wife refuses to live with her husband despite his provision of a safe and separate home—and without any proof of cruelty or non-payment of Dower—she may legally forfeit her right to financial maintenance.

• Children’s Rights: It is vital to note that while a wife’s maintenance may be suspended under these specific conditions, the father’s duty to maintain his children remains unconditional and must be fulfilled regardless of the mother’s status.
